PTIN and EA Renewals

Have you renewed your PTIN for 2026 yet? The non-refundable PTIN fee is $18.75, and the renewal can be done online at IRS.gov/taxpros. While there, check your CE totals for each year to ensure you have enough and that you have two ethics hours for each year. BTW, all EAs must have a valid PTIN, no matter if you prepare tax returns or not.

What about your EA renewal? If your SSN ends in 4, 5, or 6, it’s time to apply for the next 3-year cycle. Enrolled agents must obtain 72 hours of continuing education every three years. A minimum of 16 hours must be earned per year, two of which must be on ethics. Enrolled agents must use an IRS approved CE provider (which GAEA is!).

IRS to End Acceptance of Paper Checks After September 2025

IRS to End Acceptance of Paper Checks After September 2025

Taxpayers urged to switch to digital payments

Beginning October 1, 2025, the Internal Revenue Service (IRS) will no longer accept paper checks for tax payments, marking a significant shift toward digital transactions. This change is aimed at streamlining payment processing and enhancing security, as the IRS encourages taxpayers to use electronic payment methods such as direct bank transfers, credit cards, and the IRS’s online payment portal. Taxpayers who typically mail checks are advised to update their payment habits ahead of the September 30 deadline to avoid delays or complications with their tax obligations.

FinCen New Reporting Deadline

FinCEN Extends Beneficial Ownership Information Reporting Deadline by 30 Days; Announces Intention to Revise Reporting Rule WASHINGTON, D.C. –– With the February 18, 2025, decision by the U.S. District Court for the Eastern District of Texas in Smith, et al. v. U.S. Department of the Treasury, et al., 6:24-cv-00336 (E.D. Tex.), beneficial ownership information (BOI) reporting requirements under the Corporate Transparency Act (CTA) are once again back in effect. However, because the Department of the Treasury (Treasury) recognizes that reporting companies may need additional time to comply with their BOI reporting obligations, FinCEN is generally extending the deadline 30 calendar days from February 19, 2025, for most companies.

Notably, in keeping with Treasury’s commitment to reducing regulatory burden on businesses, during this 30-day period FinCEN will assess its options to further modify deadlines, while prioritizing reporting for those entities that pose the most significant national security risks. FinCEN also intends to initiate a process this year to revise the BOI reporting rule to reduce burden for lower-risk entities, including many U.S. small businesses.

Updated Deadlines

For the vast majority of reporting companies, the new deadline to file an initial, updated, and/ or corrected BOI report is now March 21, 2025. FinCEN will provide an update before then of any further modification of this deadline, recognizing that reporting companies may need additional time to comply with their BOI reporting obligations once this update is provided.

• Reporting companies that were previously given a reporting deadline later than the March 21, 2025 deadline must file their initial BOI report by that later deadline. For example, if a company’s reporting deadline is in April 2025 because it qualifies for certain disaster relief extensions, it should follow the April deadline, not the March deadline.

• As indicated in the alert titled “Notice Regarding National Small Business United v. Yellen, No. 5:22-cv-01448 (N.D. Ala.)”, Plaintiffs in National Small Business United v. Yellen, No. 5:22-cv 01448 (N.D. Ala.)—namely, Isaac Winkles, reporting companies for which Isaac Winkles is the beneficial owner or applicant, the National Small Business Association, and members of the National Small Business Association (as of March 1, 2024)—are not currently required to report their beneficial ownership information to FinCEN at this time.

Reporting companies can report their beneficial ownership information directly to FinCEN, free of charge, using FinCEN’s E-Filing system available at https://boiefiling.fincen.gov. More information is available at fincen.gov/boi.

Background

On January 7, 2025, the U.S. District Court for the Eastern District of Texas issued an order staying FinCEN’s regulations implementing the BOI reporting requirements, precluding FinCEN from requiring BOI reporting or otherwise enforcing the CTA’s requirements. On February 5, 2025, the U.S. Department of Justice—on behalf of Treasury—filed a notice of appeal of the district court’s order and, in parallel, requested a stay of the order during the appeal.

On February 18, 2025, the court agreed to stay its January 7, 2025, order until the appeal is completed. Given this decision, FinCEN’s regulations implementing the BOI reporting requirements of the CTA are no longer stayed. Thus, subject to any applicable court orders, BOI reporting is now mandatory, but FinCEN is providing additional time for companies to report.

Since last tax season, the improvements include more access to tax account information from text and voice virtual assistants, expanded features on the IRS Individual Online Account, more access to dozens of tax forms through cell phones and tablets, and expanded alerts for scams and schemes that threaten taxpayers. The IRS is once again working to provide taxpayers expanded help in-person through more hours at Taxpayer Assistance Centers nationwide. The IRS also will be focused on continuing high levels of service on its main taxpayer phone lines, with a goal of up to 85% level of service. “These taxpayer-focused improvements we’ve done so far are important, but they are just the beginning of what the IRS needs to do,” said IRS Commissioner Danny Werfel. “More can be done with continued investment in the nation’s tax system.”

The IRS expects more than 140 million individual tax returns for tax year 2024 to be filed ahead of the Tuesday, April 15 federal deadline.
Tax Reduction Opportunity for Retired Fire, police, and EMS Personnel

Retired fire, EMS, and police personnel can reduce their taxable earnings by up to $3,000 for medical insurance premiums paid during a calendar year under the HELPS Retiree Act.

Prior to 2023, there was a requirement that the premium had to be deducted from the retiree’s pension check to qualify for the HELPS tax reduction. This is no longer the case following the adoption of the Federal Secure 2.0 retirement law.

Premiums paid directly for health, accident, or long-term care insurance qualify for the tax credit.

The reduction is claimed on the retiree's personal 1040 tax form on Line 5B or a similar adjustment.

Married couples where both parties are retired police/fire/EMS may take a reduction of up to $6,000.

The tax break is not available to surviving spouses.

IRS Reduces PTIN Fees

The IRS has released final regulations regarding certain user fees that tax return preparers have to pay. The PTIN fee is now $11, plus $8.75 for the processing fee, for a total of $19.75.

In 2010 the total fee was $63 and in 2015 the IRS reduced it to $50. After a flurry of lawsuits and appeals starting in 2017, the Courts determined that the charges need only to be reasonably related to the cost to the agency and the value to the recipient. In 2023, the court concluded that the PTIN fees for fiscal years 2011 through 2017 were excessive.

IRS Taxpayer Advocate Reveals IRS Has Processing Backlog of 29-million Returns

The taxpayer advocate posted a blog last Thursday announcing the IRS has a return processing backlog of more than 29-million tax returns at this point.

Causes include inability to reprogram IRS computers for late tax law changes Congress passed in December and March, as well as resource overload from additional activities loaded onto the IRS by Congress.

IRS Asks Taxpayers Not to File Amended Returns to Claim New Unemployment Tax Exclusion

IRS officials are telling tax professional organizations that taxpayers should not file amended 2020 tax returns at this time to claim the new $10,200 tax exclusion for 2020 payments of unemployment compensation.

IRS Commission Charles Rettig told a Congressional committee on Thursday, March 18th that he expects the IRS will be able to identify the alread-filed 2020 returns that contain unemployment income and send taxpayers refunds based on the new 2020 exclusion.

IRS Extends Filing Deadline Again!

The IRS has finally responded to pleas from members of Congress and tax professional organizations and extended the regular tax filing deadline for 2020 individual income tax returns to May 17, 2021.

The extension will cover both the filing of an individual 2020 tax return and any 2020 tax due.

https://www.irs.gov/newsroom/tax-day-for-individuals-extended-to-may-17-treasury-irs-extend-filing-and-payment-deadline

The extension does not apply to other tax returns or payments normally due on April 15th - for example the first quarter 2021 estimated tax payments are still due on April 15th.

The IRS has announced that further guidance will be provided regarding all the tax deadlines and procedures impacted by the filing extension.

The Kiplinger Tax Letter quotes sources at the Internal Revenue Service as saying the Modernized E-File system will add the capability to electronically file amended 2019 tax returns by late this summer.

Currently, all amended returns must be filed on paper, and return processing has been substantially delayed by the coronavirus shutdown at the IRS.

Covid-19 Updates from IRS Liaison

The IRS continues to update the FAQs on IRS.gov. Below are some of the most common ones we have been asked. Please help us get the word out to SSI and VA benefit recipients about using the IRS Non-Filers tool www.irs.gov/nonfilereip by May 5th to add $500 to their Economic Impact Payments, if they have eligible children. I’m attaching images and including some tweets that can be shared and used on social media. Let me know if you post any so that I can share that my stakeholders are helping us to get these messages out to everyone.

WASHINGTON — As Economic Impact Payments continue to be successfully delivered, the Internal Revenue Service today reminds taxpayers that IRS.gov includes answers to many common questions, including help to use two recently launched Economic Impact Payment tools.

The IRS is regularly updating the Economic Impact Payment and the Get My Payment tool frequently asked questions pages on IRS.gov as more information becomes available.

Get My Payment shows the projected date when a deposit has been scheduled. Information is updated once daily, usually overnight, so people only need to enter information once a day. Those who did not use direct deposit on their 2018 or 2019 tax return can use the tool to input information to receive the payment by direct deposit into their bank account, so that they can get their money faster.

The Non-Filers Enter Payment Info tool is helping millions of taxpayers successfully submit basic information to receive Economic Impact Payments quickly to their bank accounts. This tool is designed only for people who are not required to submit a tax return. It is available in English through Free File Fillable Forms and in Spanish through ezTaxReturn.

Frequently asked questions continually updated on IRS.gov

Taxpayers should check the FAQs often for the latest additions; many common questions are answered on IRS.gov already, and more are being developed. Here are answers to some of the top questions people are asking.

Get My Payment says that my Economic Impact Payment was sent to an account I don't recognize. Why is that, and how do I get my payment?

When some taxpayers file their tax return, they may choose an option available from their tax preparer or software provider to help them pay their fees, get their refund more immediately or even load the refund onto a direct debit card. This group of different products is referred to as refund settlement products. In these situations, taxpayers may:

· Use a banking product to help them complete the tax filing transaction, sometimes referred to as a Refund Anticipation Loan (RAL) or a Refund Anticipation Check (RAC).

· Choose to have their tax refund loaded onto a debit card provided by a variety of groups in the tax and financial communities.

When you filed your tax return, if you chose a refund settlement product for direct deposit purposes, you may have received a prepaid debit card. In some cases, your Economic Impact Payment may have been directed to the bank account associated with the refund settlement product or prepaid debit card.

If the refund settlement product or the associated account is closed or no longer active, the bank is required to reject the deposit and return it to the IRS. Once the returned payment to the IRS is processed, the "Get My Payment" app will be updated.

Once the returned payment is processed by the IRS, the payment will automatically be mailed to the address on the 2019 or 2018 tax return, or the address on file with the U.S. Postal Service – whichever is more current. The status in Get My Payment will update accordingly. Timing of this process depends on several variables, including when and how the payments are rejected and returned to the IRS, when "Get My Payment" updates, and when taxpayers check the tool.

The IRS also noted that it has resolved a reporting error that some taxpayers may have experienced, which inaccurately indicated rejected payments were being sent back to the same taxpayer account a second time. They are actually being mailed to the taxpayers. The IRS has quickly taken steps to correct this reporting error. "Get My Payment" was updated starting Tuesday, April 21 to reflect that the taxpayer's payment has actually been mailed, and not rerouted to a closed bank account.

Why am I receiving an error message when entering my personal information or tax information?

To ensure the information is entered correctly, please use the help tips provided when entering the information requested to verify your identity. If the information you enter does not match our records, you will receive an error message. Check the information requested to ensure you entered it accurately.

You may want to check your most recent tax return or consider if there is a different way to enter your street address (for example, 123 N Main St vs 123 North Main St). You may also verify how your address is formatted with the US Postal Service (USPS) by entering your address in the USPS ZIP Lookup tool, and then enter your address into Get My Payment exactly as it appears on file with USPS.

If you receive an error when entering your Adjusted Gross Income (AGI), refund amount, or amount you owed, make sure you are entering the numbers exactly as they appear on your Form 1040 or tax transcript. If the numbers from your 2019 tax return are not accepted, try the numbers from your 2018 tax return instead.

If the information you enter does not match our records three times within 24 hours, you will be locked out of Get My Payment for 24 hours for security reasons. You will be able to access the application again after 24 hours. There is no need to contact the IRS.

Traders in Virtual Currencies are Targeted by the IRS

The Internal Revenue Service has begun sending letters to taxpayers who sold virtual currencies and failed to report the sales on their income tax returns.

The IRS has announced that more than 10,000 taxpayers will receive these letters. Some of the letter recipients have been identified to the IRS based on information reported by virtual currency exchanges, some of which have been cooperating with the IRS requests to submit data on their clients' virtual currency transactions.

There are three forms of the letter, called Letter 6173, Letter 6174 or Letter 6174-A, which are aimed at helping taxpayers better understand the tax filing obligations relating to virtual currency transactions.

IRS Notice 2014-21 contains more details regarding IRS regulations covering virtual currency transactions, and the obligation of taxpayers to report those transactions on their tax returns.

Cost of Genetic Testing May Be Partially Tax-Deductible

The IRS recently issued a private letter ruling that part of the cost of genetic testing may be tax deductible as a qualified medical expense if part of the service includes a medical analysis of the results of the genetic test and results in a report that is presented to the taxpayer's health care providers.

A private letter ruling is issued in response to a request from an individual taxpayer for IRS guidance regarding a tax issue. It may not be cited as a precedent by others taxpayers, but is viewed by tax professionals as a good indicator of the IRS thinking on a particular issue.

Find more details in this article from accounting web.

IRS Waives Some Penalties for Underpayment of 2018 Tax

The Internal Revenue Service is automatically waiving the estimated tax penalty for some taxpayers who have already filed their 2018 tax returns and did not claim a penalty waiver.

The IRS earlier this year lowered the usual penalty threshold of payment of 90% of the tax owed on the return, to 80%, to help taxpayers who, under the new tax laws, came up short of required estimated tax payments for 2018.

If you filed your tax return before mid-August and paid an underpayment penalty, you may qualify for a penalty waiver. Over the next few weeks, the IRS will be mailing out notices granting this relief to affected taxpayer. Taxpayers who qualify for relief under the lower 80% threshold will receive refunds of the penalty and any interest paid when they filed their return.

For details, see the IRS news release.
